1. Acceptance of Terms

By accessing or using this website, you (“Client,” “Customer,” or “User”) agree to be bound by these Terms and Conditions and all applicable laws. If you do not agree, please refrain from using this website or engaging Devan’s Designs, LLC (“Company,” “we,” or “us”) for any services.

2. Services Provided

Devan’s Designs, LLC provides website design, graphic design, and digital marketing services (“Services”).
All services are custom, digital, and tailored to each client’s needs.

No physical goods are sold, and no user accounts are created on the website. All projects are initiated through direct communication, quote acceptance, and full payment before work begins.

3. Payments and Invoicing

  • All invoices are issued via QuickBooks, and payments are accepted through QuickBooks online payment links, Venmo Business, or CashApp Business.

  • Full payment is required before design work begins.

  • Payments are non-refundable once work has started due to the custom nature and time investment involved.

  • Prices are listed in U.S. dollars (USD).

4. Revisions and Additional Work

  • Each project includes up to three (3) rounds of revisions after the initial design draft.

  • Additional revisions or add-on work (such as new pages, redesigns, or additional content) will be billed at an hourly rate of $30.

  • Revisions are considered complete when the client approves the final deliverables in writing (email or message confirmation).

5. Monthly Maintenance Plan

Clients may optionally subscribe to a Website Maintenance Plan for $45 per month, which includes:

  • Routine updates to website content (text, images, or layout adjustments)

  • Technical updates (plugin updates, performance checks, and general upkeep)

  • Minor design adjustments and text edits as needed

Billing:

  • Maintenance fees are automatically billed monthly on the same date each month using the payment method on file.

  • Clients may cancel anytime with written notice (email). Cancellations are effective at the end of the current billing cycle.

  • No refunds are issued for partial months.

6. Ownership and Intellectual Property

  • Until payment is received in full, all designs, website files, and related content remain the intellectual property of Devan’s Designs, LLC.

  • Upon full payment, the client is granted full rights to use, display, and operate the final website for their business.

  • The Company retains the right to display the completed work in its portfolio or promotional materials.

  • The underlying design concepts, templates, and development framework remain the property of the Company unless otherwise agreed in writing.

7. No Returns or Refunds

Due to the digital and customized nature of all services, all sales are final.
Refunds or returns are not available once work has begun.

8. Client Responsibilities

Clients agree to:

  • Provide accurate, complete information and materials necessary to complete the project.

  • Respond promptly to communications and approvals to ensure timely completion.

  • Obtain all necessary rights or permissions for content provided to Devan’s Designs, LLC.

9. Use of Website

Users agree not to use this Site for unlawful purposes or in a manner that could damage, disable, or impair its operation. The Company is not responsible for third-party links or content accessible through this Site.

10. Limitation of Liability

Devan’s Designs, LLC is not liable for:

  • Any indirect, incidental, or consequential damages arising from use or inability to use the website or services.

  • Any loss of revenue, data, or business opportunities resulting from website downtime or client-approved content.

  • Delays caused by client inaction, late content delivery, or third-party service failures.

All services are provided “as is” without warranty of any kind, express or implied.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts located within Strafford County, New Hampshire.

12. Modifications

Devan’s Designs, LLC reserves the right to update or modify these Terms at any time without prior notice. Changes become effective upon posting on this website.

13. Portfolio Display Consent

Client grants Devan’s Designs, LLC a non-exclusive right to display completed work samples for marketing or portfolio purposes, unless the Client requests confidentiality in writing.

14. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force. Failure by the Company to enforce any right shall not constitute a waiver of that right.

15. Entire Agreement

These Terms, together with our Client Service Agreement, Website Maintenance Agreement, and Pricing Policy, constitute the entire understanding between the Parties.
